Heard Mr. Parashuram Singh, learned counsel for the petitioner and Mr. Bharat Lal, learned counsel for the State. The petitioner seeks bail in connection with Sonpur P.S. Case No. 1207/2018 instituted for the offences under Sections 341, 323, 324, 307, 504, 379 and 34 of the Indian Penal Code. The informant is alleged to have been surrounded by the four accused persons including petitioner, who assaulted him by fists and slaps and also divested him from his personal

belongings. So far petitioner is concerned, he is said to have assaulted the informant by means of a knife which hit him near his right eye.

It has been submitted on behalf of the petitioner that absolutely false case has been instituted against him, his son and others. The real fact is that while the son of the petitioner, namely, Arun Kumar was irrigating his field, the informant and his family members came and assaulted him. All other persons of this case have been granted bail. The petitioner is in custody since 29.02.2020.

Though, there is no injury report on the record but the learned counsel for the petitioner submits that injury is absolutely superficial.

Regard being had to the afore-stated facts specially the period of custody of the petitioner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the

satisfaction of learned Chief Judicial Magistrate, Saran, Chapra, in connection with Sonpur P.S. Case No. 1207/2018. (Ashutosh Kumar, J) Sunil/- U T
