This application, for grant of anticipatory bail, arises out of Mufassil Police Station Case No. 368 of 2018, disclosing offences under Sections 147, 341, 323, 332, 353, 427, 283 of the Indian Penal Code and Section 3 of the Prevention of damage to Public Property Act, 1984.
The informant is the Assistant Sub-Inspector of Police. It is alleged in the First Information Report that local people were protesting against the death of a girl in an accident and they were obstructing movement on the road. When the Police attempted to intercede, the accused persons, 17 of whom have been named and others 50-60 people not named, caused
Patna High Court CR. MISC. No.20569 of 2019(2) dt.03-04-2019 2/2 obstruction and damaged the Government vehicle. Considering the general and omnibus nature of accusation, this application is allowed.
Let the petitioner, namely, Kishore Yadav @ Kishori Yadav, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Mufassil Police Station Case No. 368 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
