2. The petitioner seeks regular bail in a case registered for the offence under Sections 363, 365 of the Indian Penal Code and Section 04 of the POCSO Act.

3. As per the prosecution case, petitioner is accused of kidnapping the victim girl.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner is in custody since 04.11.2023 and has clean antecedent.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. From perusing the statement of the victim girl

Patna High Court CR. MISC. No.28139 of 2024(2) dt.24-04-2024 2/2 before the police, it appears that this is a case of elopement.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cum-Special Judge, POCSO & SC/ST Act, Jamui/concerned Court below in connection with Jhajha P.S. Case No. 532 of 2023.

9. This application stands allowed.
