JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-12-2018 The petitioner seeks bail in connection with Deepnagar P.S.Case No. 299 of 2018 registered under Sections 272, 273 and 290 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation is of recovery of 10 litres country made liquor from the possession of the petitioner and he is an accused in one more case of similar nature.

Submission of learned counsel for the petitioner is that petitioner has been falsely implicated in this case, nothing has been recovered from his possession and petitioner is in custody since 26.10.2018.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner at

Patna High Court Cr.Misc. No.69340 of 2018(2) dt.05-12-2018 2/2 this stage.

However, once the petitioner completes three months custody or the charge is framed against him, whichever is earlier, the trial court shall release the petitioner on bail. Accordingly, this application stands disposed of. (Vinod Kumar Sinha, J) sujit/- U T
