====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioners and the State.

Petitioners are apprehending their arrest in connection with a case for the offence under Sections 420, 409 and other allied Sections of the Penal Code registered in connection with illegal allotment of house under Indira Housing Scheme. It is said that the house meant for those who were handicapped has been allotted to persons who do not suffer from any disability. Petitioners are not named in the First Information Report, it is said that others who are named in the First Information Report have been admitted to the

Patna High Court Cr.Misc. No.41411 of 2015 (2) dt.15-10-2015 privilege of bail in the event of arrest by another Bench of this Court under order dated 03.09.2014, 15.01.2015, 22.05.2015 and 07.10.2015 passed by this Court in Cr. Misc. Nos. 22008, 29864, 46541 all of 2014 and 38999 of 2015 respectively.

Petitioners being not named in the First Information Report, are directed to surrender in the court below within four weeks from the date of receipt/production of a copy of this order in the court below, thereafter be released on bail on furnishing bond of Rs. 5,000/- (five thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Motihari, East Champaran in connection with Paharpur P.S.

Case No. 188 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (V.N. Sinha, J) P.K.P.
