Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.

The petitioner is alleged to have committed murder of his wife for the reason that the petitioner was having extra marital relation. Marriage of the petitioner with deceased Sita Devi was solemnized 20 years back. Son Rohit, aged about 16 years and a daughter Nisha Kumari, aged about 11 years were there. The case diary reveals that there is no eye-witness of the occurrence and entire material against the petitioner is based on hearsay witnesses.

Considering the aforesaid facts, let the petitioner, above named, be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.42719 of 2016 (3) dt.13-12-2016 Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-V, Begusarai/Successor Court in connection with S.T. No. 494 of 2016 arising out of Khodabandpur (Chhourahi O.P.) P.S. Case No. 43 of 2016.
