JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-04-2019 The petitioner is aggrieved by the action of the respondents in not appointing her as Talimi Markaj (Tola Sevak) even though she has all the qualifications for being appointed on such post. Under the rules framed for appointment of Vikash Mitras/Talimi Markaj, complaints with respect to the selection process are to be received by the Sub-Divisional Officer or SubDivisional Welfare Officer and the entire selection process is required to be completed under the supervision of concerned District Magistrate.

The complaint can either be examined by the District Magistrate or the competent officer of the Bihar Mahadalit Vikash Mission. Any order passed by the aforesaid authorities is appealable before the State Office of Bihar Mahadalit Vikash Mission.

Mr. Dhiraj Kumar, learned advocate for the petitioner,

Patna High Court CWJC No.7200 of 2019(2) dt.29-04-2019 2/2 after some arguments, seeks permission to withdraw this petition in order to enable the petitioner to file a fresh complaint before the District Magistrate, Gaya within a period of four weeks from today, on receipt of which, the same shall be examined by the District Magistrate, Gaya and a reasoned order shall be passed within a further period of four weeks thereafter. If the petitioner remains dissatisfied with the order, she would have the forum of appeal before the State Office of Bihar Mahadalit Vikash Mission, Patna.

With the aforesaid observation/direction, the writ petition is permitted to be withdrawn.
