Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defect(s) as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406, 467, 468 and 471/34 of the Indian Penal Code. It is a case of illegally withdrawal of Rs.14,200/- from the account of the informant by the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that he is ready to pay the amount of

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Jokihat (Mahalgaon) P.S. Case No. 22 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. with further condition that at the time of furnishing bail bond before the court concerned, the petitioner shall also deposit a sum of Rs.14,200/- for its payment to the informant, otherwise the bail bond of the petitioner shall be cancelled.
