JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148 and 302 of the Indian Penal.

Though the petitioner is named in the F.I.R. but the specific case of the prosecution is against the co-accused, namely, Mrityunjay Sharma and Sanjay Sharma, who mercilessly assaulted the deceased by means of iron rod and stick. Moreover, having similar allegation co-accused, namely, Munna Sharma, has already been granted privilege of bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as

No.37579 of 2016 (2) dt.09-09-2016 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Daudnagar, Aurangabad in connection with Khudwan P.S. Case No. 04 of 2016.
