The petitioners have preferred this application for grant of regular bail in a case registered under sections 302 and 201 of the Indian Penal Code.
As per the prosecution case, the daughter of the informant was married to the son of petitioner nos.1 and 2. It is stated that she was tortured for non-fulfillment of demand of dowry to the tune of Rs.65,000/ for the purpose of purchasing a motorcycle. Ultimately she was done to death. It is submitted by learned counsel for the petitioners that the petitioners are the mother-in-law, father-in-law and brother-in-law (devar) of the deceased. The allegations are false
Patna High Court CR. MISC. No.22093 of 2022(3) dt.11-01-2023 2/2 and concocted. The husband of the petitioner is in custody. The petitioners are in custody since 10.8.2021 and investigation in the case has concluded.
Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioners being the mother-in-law, father-in-law and devar of the deceased, the husband of the deceased being in custody together with the petitioners having remained in custody for 1 year 4 months since 10.8.2021, the Court directs all the three petitioners to be enlarged on bail in connection with Bihta P.S. Case no.368 of 2017 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Danapur, District Patna.
