Petitioner apprehends his arrest in a case under Sections 498(A) and 307/34 of the I.P.C.

The wife of the petitioner made allegation that the petitioner subjected her physically and mentally due to nonfulfillment of demand of dowry and petitioner assaulted her with knife in her rib.

It is submitted that the wife has already solemnized second marriage.

On the other hand, learned Additional P.P. opposed the prayer for anticipatory bail.

Considering the facts that there is specific allegation that

Patna High Court Cr.Misc. No.49417 of 2014 (2) dt.09-04-2015 2 / 2 the petitioner assaulted his wife with knife, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected in Hathauri P.S. Case No. 139 of 2012, pending in the court of the learned C.J.M. Muzaffarpur.
