The petitioners apprehend their arrest in G.B. Nagar P.S. Case No. 220 of 2016, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. The informant alleged that on petty dispute of taking money Deonandan Singh and 4-5 unknown criminals assaulted Lalu Yadav and Lalu Yadav died.
Learned counsel for the petitioners submits that the informant named Deo Nandan Singh but if the petitioners participated in the crime, the informant would have named the petitioners also, as they are brother, nephew and son of Deo Nandan Singh. The informant was examined as P.W. 2 in the trial
Patna High Court Cr.Misc. No.17395 of 2017 (2) dt.15-05-2017 2/2 and he did not disclose the name of the petitioners but, from perusal of the order rejecting prayer for anticipatory bail of the petitioners, it appears that during course of investigation the witnesses have named the petitioners that, they along with Deo Nandan Singh assaulted Lalu Yadav resulting in his death. The trial of Deo Nandan Singh has already begun.
Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
