Petitioner seeks bail in a case registered for the offences punishable under Sections 15(2),15(4) Petroleum and Mineral Pipe Line Act, 1962 and 3/4 of Explosive Substance Act, 1984.
Only suspicion is there against the petitioner that he was committing theft of petroleum product from pipelines.
Submission is that the petitioner has got no criminal antecedent. He is in custody since 27.11.2018. Investigation of the case is already closed.
Learned counsel for the informant opposed the
Patna High Court CR. MISC. No.20013 of 2019(2) dt.01-05-2019 2/2 prayer for bail on the ground that place of theft is a lonely place and on the basis of location of mobile phone of the petitioner and others, they were named in this case.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Athmalgola Police Station Case No.297 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
