The petitioner seeks bail in connection with Samastipur Rail P.S. Case No.69 of 2015/N.D.P.S. Case No.1 of 2016 registered under Sections 401 and 414/34 of the Indian Penal Code besides Sections 20 and 22 of the N.D.P.S. Act, pending in the court of the Additional Sessions Judge-I, Samastipur. The accusation is that in course of checking of Jan Sadaharan Express Train at Platform No.1 of Samastipur Railway Station, the petitioner was searched and 13 Antivan Tablets, one mobile set, one railway ticket etc. were recovered from his
Patna High Court Cr.Misc. No.3212 of 2017 (8) dt.03-05-2017 2/2 possession.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is in custody since 07.11.2015. It appears from paragraph-3 to this application that the petitioner has criminal antecedent of eight cases out of which, one case is under the N.D.P.S. Act also.
Having regard to the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant bail to the petitioner for the present. Accordingly, the prayer of the petitioner for grant of bail stands rejected for the present. (Rajendra Kumar Mishra, J) P.S./- U T
