JUSTICE SANJAY PRIYA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Banka (Barahat) P.S. Case No. 78 of 2013 instituted for the offence under Sections 307/34 of the Indian Penal Code, Sections 25(1b)a, 26 and 35 of the Arms Act. It is alleged in the written report that the petitioner and Md. Jakaul attempted to kill the informant by country made pistol. It is further alleged that the informant snatched the pistol from the possession of the petitioner.

From the production-cum-seizure list, it appears that country made pistol was produced before the police by the informant.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.10616 of 2017 (2) dt.10-03-2017 2/2 prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Banka (Barahat) P.S. Case No. 78 of 2013, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
