JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,379 and 498A/34 of the Indian Penal Code and section 4 of the Dowry Prohibition Act.

The basic accusation is of torture for non fulfillment of dowry demands.

It is submitted by learned counsel for the petitioner that the petitioner and informant have parted ways on payment of permanent alimony of Rs.3,75,000/- and a petition to that effect has been filed before the learned court below which has been brought on record as Annexure 2.

Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.49236 of 2014 (2) dt.13-02-2015 2/2 petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sitamarhi Sadar in connection with Sonbarsa P.S. Case No. 68 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bond of the petitioner shall be accepted by the learned court below on verification of the record whether any compromise petition has been filed with the signature of the informant or not.
