The petitioner apprehends his arrest in Hathidah P.S. Case No. 86 of 2016 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code. The gist of the allegation is that the petitioner did not handover any folder, file, provisional and final merit list relating to the appointment of teachers in Gram Panchayat Raj Hathidah Buzurg in the year 2003, 2005, 2006, 2008 and 2012. Learned counsel for the petitioner submits that the petitioner was posted in the Panchayat on 19.10.2016 and his predecessor did not handover any documents relating to the appointment of teachers in the Panchayat.
Considering the facts aforesaid and the fact that the
Patna High Court Cr.Misc. No.15622 of 2017 (2) dt.20-04-2017 2/2 petitioner did not receive any folder, file, provisional and final merit list with regard to appointment of teachers in Gram Panchayat Raj Hathidah Buzurg, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh, Patna in Hathidah P.S. Case No. 86 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
