The petitioner seeks bail in a case registered under Sections 401, 413, 414, 420 of the Indian Penal Code. The prosecution case in brief is that on secret information, the house of one Sonu Mandal was searched and a stolen motorcycle is alleged to have been recovered. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 11-12-2018. Charge sheet has already been submitted. The petitioner has been made accused in the present case due to mistake of fact. The petitioner has got no concern with the alleged motorcycle in question. The other

Patna High Court CR. MISC. No.23621 of 2019(2) dt.18-04-2019 2/2 similarly situated co-accused has been granted bail by a coordinate bench of this Court by order dated 04-04-2019 passed in Cr. Misc. No. 20737 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. Case No. 732 of 2018.
