====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 11-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Parsa Bazar P.S. Case No.168 of 2016 registered under Sections 143, 341, 323, 448, 354 and 379 of the Indian Penal Code. The accusation is that on 17.09.2016 when the informant was going to school from her house then this petitioner alongwith his other family members caused assault to the informant and also snatched gold chain from her neck. Thereafter, when the informant returned to her house, this petitioner and his other family members entered the house of the informant, took Rs.20,000- and also snatched the gold chain of the mother of the

Patna High Court Cr.Misc. No.11976 of 2017 (2) dt.11-04-2017 2/3 informant. On protest, this petitioner caused assault to the informant on her head through the butt of pistol and all the accused started to cause assault to the family members of the informant through bricks.

Learned counsel appearing on behalf of the petitioner submits that, in fact, due to causing assault by the father of the informant and her other family members, the petitioner had made complaint before the Sarpanch of Gram Kachehri, Kurthaul (Patna) on 12.09.2016 and, thereafter, the Sarpanch of Gram Kacherhi, Kurthaul (Patna), on 16.09.2016, had warned the parents of the informant and her other family members for not committing the "Maar-Peet" in future. After that, as a counter blast, the present case has been lodged by the informant, who is own niece of the petitioner. Moreover, the injury, which is said to be caused by the petitioner and his other family members to the informant, is simple in nature.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Parsa Bazar
