JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 474 of the Indian Penal Code.

The prosecution case is that the father-in-law of the informant Rakshya Singh had six daughters and he gifted his properties to six daughters. 1 Acre 3 decimal land of Khata No. 57, Plot No. 714 was gifted on 28.01.2002 to Manish Kumar Singh, son of the complainant. Subsequently the wife of original land holder(mother-in-law of the complainant) sold the same gifted land in 2014 to one Suresh Mahto. It is submitted by learned counsel for the petitioner that Hirdya Kuer being the wife of original land holder Late Rakshya Singh, sold the land in question. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (T) P.S. Case No. 29 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
