14.08.2015 Considering that four witnesses have already been examined, I do not find any justification for transfer the case from Gaya to Munger.
The Trial Court is directed to expedite the trial and conclude the same within the shortest possible time without granting unnecessary adjournment to any party and for which reason he is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order, to the Superintendent of Police, Gaya, and the Superintendent of Police, Gaya is directed to ensure production of the
Patna High Court Cr.Misc. No.12891 of 2013 (8) dt.14-08-2015 witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
The Petitioner undertakes to produce the witnesses on the dates fixed.
It is made clear that if the Petitioner ever feels apprehension to danger of his life he shall file petition in the Court below upon which he shall ensure security to the Petitioner and his witnesses at his cost. Let this order be communicated to the Chief Judicial Magistrate, Gaya in connection with Civil Lines P.S. Case No. 229 of 2012.
The Application stands disposed off with the aforesaid observations.
