====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 04-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Adapur P.S. Case No. 10 of 2018 instituted for the offence under Sections 25(1-b)a, 26 and 35 of the Arms Act.
Counsel for the petitioner submits that petitioner is in custody since 11.1.2018.
In the written report it is alleged that one loaded Katta, live cartridges, one fired Khokha and Rs. 800/- have been recovered from possession of the petitioner. Seizure list has been prepared which is part of First Information Report wherein Police has not mentioned any recovery of firearm from conscious possession of the petitioner. Petitioner is said to be in custody since 11.01.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari, in connection with Adapur P.S. Case No. 10 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
