The petitioners seek pre-arrest bail in Bhargama P.S. Case No.147 of 2016 (G.R. No.3411/16) registered for the offence under Sections 364 and 34 of the I.P.C. Accusation is of killing of the daughter and the grand son (Nati) of the informant and disposing of their dead body by her in-laws.

Learned counsel appearing on behalf of the petitioners submits that the prayer of pre-arrest bail of the petitioners has already been rejected vide order dated 30.01.2017 passed in

Patna High Court CR. MISC. No.22924 of 2019(5) dt.02-08-2019 2/2 Cr.Misc.No.838 of 2017. But now the informant and the petitioners and other accused have filed the compromise petition in the court of Chief Judicial Magistrate, on 15.10.2018. Since the prayer for pre-arrest bail of the petitioners has already been rejected by this Court earlier. Hence, present application for pre-arrest bail is rejected.

However, the petitioners are directed to surrender before the court below and pray for regular bail and on their so surrendering the court below will consider the same on its own merit without being prejudiced by this order. (Rajendra Kumar Mishra, J) aks/- U
