JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 414/34 of the Indian Penal Code.
In huge quantity clothes and other articles were recovered from Maruti Van, which was being used as Ambulance. Petitioner and two others were caught. Petitioner claims that he is owner of the aforesaid Maruti Van and, as a matter of fact, he had gone to Patna along with a patient and while returning, the other accused boarded in the said Ambulance. Moreover, there is nothing in the F.I.R. as well as the impugned order to show that seized articles were stolen property.
Considering the aforesaid facts and circumstances as

No.36306 of 2016 (2) dt.23-08-2016 2/2 well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Munger in connection with Naya Ram Nagar (Safiyasarai) P.S.
