The application is for grant of bail for the offence under Section 115 of the Indian Penal Code.
It is submitted on behalf of petitioner that though it is alleged in the FIR that from call details it appears that petitioner while in judicial custody, making calls to some one thatching conspiracy for killing one Ghosh Yadav of tempo stand but from perusal of case diary, it appears that police has not found any Ghosh Yadav of tempo stand and even no mobile was found on search of jail. It has also been submitted that petitioner is in custody since 30.06.2016. It is further submitted that he has already filed a supplementary affidavit before this court stating
Patna High Court Cr.Misc. No.48465 of 2016 (5) dt.12-01-2017 2/2 that he has been granted bail in all other cases. Heard learned A.P.P. also. Learned A.P.P. could not controvert the aforesaid fact.
Having heard both sides. In above view of the matter, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Munger Kotwali P.S. case no. 147 of 2016.
