The petitioner apprehends his arrest in connection with Kawakole (Rupou) P.S. Case No. 156 of 2016 registered under Sections 30(a) of the Bihar Prohibition and Excise Act. Allegation, in brief, is that the petitioner and others were carrying foreign liquor and other articles from Jharkhand to Bihar and the informant, who is the police Officer, identified this petitioner carrying liquor. However, he escaped away and could not be apprehended.
The learned counsel appearing on behalf of the petitioners submitted that the allegation is false and nothing was recovered from his possession.
Considering the aforesaid facts and circumstances, I am
Patna High Court Cr.Misc. No.5392 of 2017 (2) dt.06-02-2017 2/2 not inclined to admit the petitioner on anticipatory bail. The prayer for anticipatory bail is rejected.
However, if the petitioner surrenders in the court below and prays for regular bail, then his prayer for bail shall be considered on its merit without being prejudiced by this order. (Arun Kumar, J) BTiwary/- U T
