JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Amarpur P.S. Case No. 162 of 2018, dated 06.04.2018, instituted for the offences under Sections 147, 148, 341, 323, 307, 379 and 447 of the Indian Penal Code.
The learned counsel for the petitioners, from the First Information Report, has pointed out that the allegation of assault on the informant and his family members has been made in general and omnibus terms, so far as the petitioners are concerned. There is a counter version of the
Patna High Court Cr.Misc. No.69379 of 2018(2) dt.19-12-2018 2/2 occurrence lodged by the father of petitioner No. 2 vide Amarpur P.S. Case No. 160 of 2018, which has been annexed to the bail petition as Annexure-2. It has further been submitted on behalf of the petitioners that the injuries suffered by the informant and others are simple in nature. Regard being had to the fact that the petitioners are the agnates of the informant and that there is a pending land dispute between the parties, the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 162 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
