Petitioner seeks bail in Kursela P.S. Case No.74 of 2018 registered under Sections 341, 342, 323, 307, 302 and 34 of the IPC.
Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected by this court vide order dated 05.11.2018. There is of course specific allegation that the petitioner fired which hit on the left shoulder of Mangal Mandal and Mangal Mandal died. It is further submitted that out of 11 witnesses, 5 witnesses have already been examined but none of the witnesses has named the petitioner as the person, who is alleged to have fired. Having considered the facts aforesaid, I am not
Patna High Court CR. MISC. No.20041 of 2020(2) dt.19-06-2020 2/2 inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
The trial court is directed to hold the trial on day to day basis and conclude the same within four months from the day of production of this order.
The S.P., Katihar is directed to ensure the attendance of remaining prosecution witnesses (non-examined) in the court below so that the trial must be concluded within four months.
