The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act.

It is a case of recovery of foreign liquor from behind the house of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Petitioner has clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Patna High Court CR. MISC. No.22105 of 2022(2) dt.31-08-2022 2/2 Considering the aforesaid facts and circumstances of the case as well as the fact that the liquor was recovered from behind the house of the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.

However, the petitioner is directed to surrender before the court below and pray for regular bail.
