2. The petitioner seeks bail in connection with Gogari P.S. Case No. 227 of 2023 registered for the offence punishable under Sections 341, 323, 324, 307 and 504/34 to which later on Section 302 of the Indian Penal Code was added.
3. From the reading of the FIR, it appears that the assailant of the deceased is Nand Deo Mandal and the occurrence took place because of dispute of selling of fish. The deceased died one month after the occurrence because of Septicemia. Nanddeo Mandal prayer for bail has already been rejected by order dated 16.04.2024 in Cr. Misc. No. 7689 of 2024. The petitioner is in jail since 31.01.2024.
4. Learned APP appearing for the State opposes the
Patna High Court CR. MISC. No.25712 of 2024(3) dt.05-07-2024 2/2 prayer for regular bail of the petitioner.
5. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail after framing of charge if charge has not already been framed, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria in connection with Gogari P.S. Case No. 227 of 2023, subject to the condition that the petitioner will cooperate in the trial. (Sandeep Kumar, J) P. Kumar U T
