=========================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL JUDGMENT Date: 20-08-2015 The petitioner seeks quashing of the order of cognizance dated 29.04.2011 passed by the Judicial Magistrate, Saran at Chapra in Complaint Case No. 830 of 2006.
The case of the complainant is that on the date of occurrence accused persons assaulted him and snatched Rs. 1100/-. It has been submitted on behalf of the petitioner that she is widow lady and at the relevant time she was Chairman of Nagar Panchayat, Sonepur and only because there was an altercation between staff where petitioner was present the instant case has been lodged. Evidently the allegations are frivolous and not reliable. On the last occasion notices had been issued to the O.P. No. 2 but none appeared on his behalf .
Patna High Court Cr.Misc. No.49187 of 2014 dt.20-08-2015 2/2 Having considered the frivolous nature of allegation, as against all the accused persons the order dated 29.04.2011 passed by the Judicial Magistrate, Saran at Chapra is hereby set aside. The application stands allowed.
