JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 21.7.2017 passed in Cr.Misc.No.30844 of 2017 and allegation is that petitioner called the deceased on phone and thereafter deceased was killed and petitioner is named in the FIR.

Submission of learned counsel for the petitioner is that there is absolutely nothing against the petitioner except that he called the deceased on phone and petitioner is in custody for about two and a half years. However, as the case was fixed for argument but on the petition filed by the informant now again the case has been fixed for evidence.

Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court CR. MISC. No.22535 of 2019(3) dt.20-06-2019 2/2 circumstances, as stated above, at this stage I am not inclined to grant bail to the petitioner.

However, learned trial court is directed to expedite the trial and try to conclude it as soon as possible, preferably within a period of six months.

With the above observation, this application is dismissed.
