Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defect(s) as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 34, 341, 379, 384, 504 and 506 of the Indian Penal Code. Prosecution case is about extortion of Rs.1,05,000/- from the informant on the gun point by the accused persons. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that all the episode started after filing an

Patna High Court CR. MISC. No.31357 of 2021(2) dt.18-02-2022 2/2 application by petitioner before the Collector of Samastipur against the irregularity committed by the Contractor of 'Pradhan Mantri Sarak Yojna' and subsequently filing an RTI application for the same and the said application and RTI are annexed as Annexure-2 to the present petition. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with Kalyanpur P.S.
