====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 21-09-2020 Heard the parties through the virtual court proceeding. Since physical court proceeding is not functioning due to present Pandemic Covid-19, the matter is listed with defect. Learned counsel for the petitioner undertakes to remove the defect within three weeks of normal functioning of the court after the lockdown, failing which the office is directed to place the matter before the Bench.

The petitioner seeks bail in connection with Majhaulia P.S. Case No. 458 of 2019 registered for the offences punishable under Sections 467, 468, 471, 420, 406, 34 of the Indian Penal Code.

Prosecution story is that the complainant namely Hirawati Devi is a widow and her husband expired on 29.05.2019. On 12.06.2019, one Tanu Kumari executed two sale deeds in favour of Aditya Bhatt, son of Late Tej Narayan Sharma and Pawan Kumar Sharma, son of Shayamakant Sharma where petitioner namely Ramkrishan Sharma @

Patna High Court CR. MISC. No.24110 of 2020(2) dt.21-09-2020 2/2 Ramkirit Sharma is the attesting witness in the above stated sale deeds. It is further stated that on 07.07.2019 at about 05 P.M., accused persons threatened the informant to give up their possession over their purchased land otherwise they will take the possession forcefully and kill her.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner is the only attesting witness. Petitioner is in jail custody sincde 23.01.2020. and petitioner has no criminal antecedent mentioned in paragraph-3 of the bail petition. Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Majhaulia P.S. Case No. 458 of 2019.
