JUSTICE SANDEEP KUMAR ORAL ORDER 19-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Darauli P.S. Case No. 124 of 2021, (G.R. No. 2442/2021), registered for the offence punishable under Sections 328, 304 (B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. It has come during investigation that the deceased had taken poison and she was taken to the hospital by the family members of the petitioner and the family members of the deceased were informed. The mother of the deceased was brought to the hospital by the

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Siwan, in connection with Darauli P.S. Case No. 124 of 2021, (G.R. No. 2442/2021).
