The petitioner is languishing in custody since 31.08.2018 in a case registered for the offences punishable under Sections 387, 506 and 507 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, as per the written report of Sunil Kumar, A.S.I. of Amarpur Police Station dated 30.08.2018 submitted to the Station House Officer of Amarpur Police Station, is to the effect that on the same day at 1.30 P.M., he received a secret information that petitioner has resorted to fire in the market on demand of consideration price of the slippers purchased by the petitioner.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.21277 of 2019(2) dt.05-04-2019 2/2 that on the basis of suspicion, the accusation has been levelled against the petitioner. There is no proof with regard to the purchase of the slippers from the shop of the informant. Though, the petitioner is accused in two other cases but he is on bail in those cases.

Learned APP submits that the accusation is specific against the petitioner.

Considering the nature of accusation and the fact that the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S.
