Mr.Murlidhar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-10-2020 Heard Mr Indrajeet Bhusan, learned Counsel for the petitioners and Mr. Murlidhar, learned Additional Public Prosecutor for the State.

The petitioners are apprehending arrest in connection with Mirganj P.S. Case No. 02 of 2020 registered for the offence under Sections 366, 363(A), 368, 406, 120(B) and 380 of the Indian Penal Code.

Learned counsel for the petitioners would submit that the petitioners have no criminal antecedent. They have been made accused in this case at the instance of husband of Soni

Patna High Court CR. MISC. No.23265 of 2020(2) dt.07-10-2020 2/2 Devi. A divorce case is pending between the husband and wife. When the husband of Soni Devi visited the village in drunken condition and assaulted Soni Devi, the petitioners and others have intervened and saved Soni Devi and that is the reason that petitioners have been made accused in this case. Counsel also refers to annexure-3 to contend that Soni Devi is free in her activities and movement and there is nothing like kidnapping.

Considering the facts and circumstances discussed hereinabove, the Court is inclined to grant privilege of anticipatory bail to the petitioners. Let the petitioners, above named, in the event of arrest or surrender within a period of one month from the date of communication of the order, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of ACJM -XVI, Gopalganj in connection with Mirganj P.S. Case No. 02 of 2020, subject to the conditions laid down under Section 438 (2) of Cr.P.C.
