====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 21-07-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Derni P.S. Case No. 37 of 2022 registered for the offence under Sections 363 and 366-A of the Indian Penal Code. As per allegation, the informant's minor daughter aged about 15 years went to school on 16.02.2022 but did not return back and after making an enquiry the informant raised suspicion against the petitioner and believed that her daughter has been kidnapped by the petitioner.

The main submissions advanced by learned counsel

Patna High Court CR. MISC. No.22580 of 2022(2) dt.21-07-2022 2/2 for the petitioner are that the so called victim has been recovered and she has recorded her statement under Section 164 Cr.P.C. in which she has flatly denied the allegation of kidnapping and accepted her matrimonial relationship with the petitioner who is a teenager boy.

Learned APP appearing for the State has opposed the bail prayer.

In view of the above submissions and considering the petitioner's young age and his clean antecedent and mainly the victim's statement recorded under Section 164 Cr.P.C. which is completely against the allegation of the FIR as appears from the order of Court below, in my view a lenient approach can be taken in respect of petitioner's prayer. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in Connection with Derni P.S. Case No. 37 of 2022.
