This is an application seeking quashing of the order dated 22.03.2017 passed by the learned Chief Judicial Magistrate, Buxar in connection with Rajpur P. S. Case No. 145 of 2015 (G. R. No. 2170 of 2015), by which cognizance has been taken under Sections 279, 307, 420, 216, 120(B) and 34 of the Indian Penal Code.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this petition in

Patna High Court CR. MISC. No.24062 of 2020(3) dt.16-10-2020 2/2 order to enable the petitioner to agitate the grounds taken here in this petition at the appropriate stage of framing of the charge.

Should such a petition be filed on behalf of the petitioner, the same shall be looked into by the court below and an order shall be passed taking into consideration the entire set of facts and the court below shall not be prejudiced by the fact that the present petition has not been entertained.

Disposed off as withdrawn with the liberty aforesaid.
