JUSTICE SHIVAJI PANDEY ORAL ORDER 08-12-2020 Heard learned counsel for the petitioner and learned APP for the State through Virtual Court Proceeding. In this case, the petitioner is seeking regular bail in connection with Jogbani (Bathnaha) P.S. Case No.04 of 2020, registered for the offence under Sections 489(A), 489(B), 489(C) of the Indian Penal Code and under Section 27 of the Arms Act.

On the basis of secret informant that some persons are coming for delivery of counterfeit notes, the petitioner and one other person, who were on a motorcycle, were intercepted but, one person fled away and present petitioner has been arrested. From the possession of this petitioner counterfeit notes of Rs.99,8000/- has been recovered.

Patna High Court CR. MISC. No.25177 of 2020(3) dt.08-12-2020 2/2 Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and has falsely been implicated in this case.

Looking to the entirety of the facts and circumstances of the case as well as the manner in which the counterfeit notes were tried to be delivered in the country, which will cause harm to the financial position of the country, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected for the present. (Shivaji Pandey, J) pawan/- U T
