JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 379 and 411 of the Indian Penal Code. Petitioner was caught with stolen motorcycle and disclosed that he had stolen the aforesaid motorcycle from Jhanjharpur.

Submission on behalf of the petitioner is that the seized motorcycle belongs to friend of the petitioner and, as a matter of fact, petitioner was not aware of this fact that the seized motorcycle was stolen motorcycle. It is further submitted that petitioner is languishing in jail custody since 25.6.2016 and does not have any criminal antecedent.
