The petitioner seeks bail in a case instituted for the offence under Sections 363, 366(A) of the Indian Penal Code. It has been submitted that victim girl on her recovery in her statement under Section 164 of Cr.P.C has disclosed the name of one Miroj and this petitioner, who had taken her to Amritsar and thereafter, she was taken to Delhi. Xerox copy of the statement recorded under Section 164 of Cr.P.C has been produced by the petitioner.
From perusal of statement of victim girl which is recorded under Section 164 of Cr.P.C., it appears that there is no specific overt act levelled against this petitioner by the victim girl.
Patna High Court Cr.Misc. No.53882 of 2016 (3) dt.20-01-2017 2/2 It has further been submitted that co-accused Miroj has already been granted bail by Co-ordinate Bench of this Court vide Cr. Misc. No. 47832 of 2015 dated 05.11.2015. The petitioner is in custody since 22.07.2016.
Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Dumra P.S. Case No. 397 of 2014, subject to the condition that both the bailors will be the close relative of the petitioner. (Sanjay Priya, J.) ravi/- U T
