Petitioner seeks regular bail in connection with Sessions Trial No. 76 of 2019/91 of 2019 arising out of Nabinagar P.S. Case No. 307 of 2018 registered for the offence under section 304B/34 of the Indian Penal Code and section 3⁄4 of the D.P. Act pending in the Court of Additional District and Sessions JudgeX, Aurangabad. Learned counsel for the petitioner submits that earlier prayer of the petitioner for bail was rejected on merit by this Court vide Cr. Misc. No. 36490 of 2019 on 04.09.2019. Up-till-
Patna High Court CR. MISC. No.12334 of 2020(2) dt.09-09-2020 -2now, only five witnesses have been examined. Petitioner is in custody since 29.10.2018.
Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending that there is no fresh ground in the present case. Further, he submits that on perusal of the status report, as called for from the learned court below, it appears that the trial is in progress. Having considered the above facts and circumstances of the case and the submission advanced on behalf of the State, prayer of the petitioner for bail is rejected. However, Trial Court is directed to conclude the trial within a period of three months.
