The petitioners seek regular bail in connection with Special Excise Case No.888 of 2018 arising out of Dagarua P.S.Case No.207 of 2018 registered for offences punishable under Sections 272 and 273 of the IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2016 of the Indian Penal Code.
Allegation against the petitioner is about recovery of 112 ltrs. of liquor from the Pickup Van and the petitioners were arrested from there.
Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, having no
Patna High Court Cr.Misc. No.70817 of 2018(2) dt.05-12-2018 2/2 criminal antecedent and he is in custody for two months. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, (Excise Act), Purnea in connection with Special Excise Case No.888 of 2018 arising out of Dagarua P.S.Case No.207 of 2018..
With the aforesaid observation, this application is allowed.
