Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehends his arrest in connection with Bhagwanpur Hat P.S. Case No. 79 of 2020, registered for the offences punishable under Sections 153 A of the Indian Penal Code and under Section 67 of the Information Technology Act, 2000. As per allegation, the petitioner by using his Facebook account was spreading some materials with intent to disrupt the communal harmony. Learned counsel for the petitioner has submitted that the petitioner has done nothing except forwarding the messages which have been received on his Facebook account. He has further submit-

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Siwan in connection with Bhagwanpur Hat P.S. Case No. 79 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

With further condition that at the time of surrender he shall file an affidavit that he shall not indulge in similar activity. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
