The petitioner seeks bail in a case instituted under Section 414 of the Indian Penal Code.
The allegation against the petitioner is that two stolen motorcycles are said to have been recovered from the house of the petitioner and when he was told to show the paper of both the motorcycles, the petitioner did not show any paper. Accordingly, seizure list was prepared.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.05.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The
Patna High Court Cr.Misc. No.51014 of 2016 (2) dt.28-11-2016 2/2 petitioner has falsely been implicated in the present case. From the joint family house of the petitioner, the alleged stolen motorcycles is said to have been recovered. The petitioner has got no knowledge regarding the said motorcycles. There is no compliance of Section 100 of the Cr.P.C.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hajipur in connection with Raghopur P.S. Case No. 43 of 2016.
