2. The petitioner seeks bail in connection with Session trial no. 687 of 2022 arising out of Cheriyabariyarpur P.S.Case No. 93 of 2012 registered for the offence punishable under Sections 302 of the Indian Penal Code and section 27 of the Arms Act.

3. From the report of the Additional District & Sessions Judge, Manjhaul, Begusarai, it appears that discharge application filed by the petitioner was kept pending for more than a year because of the fault of the petitioner or his lawyer. The same has been dismissed by the A.D.J, Manjhaul on 03.07.2024.

4. Though, the petitioner claims that he is in custody since 29.04.2022 but it appears that the trial has been delayed because of the pendency of the discharge application. 5.In these circumstances, this application is dismissed. The trial court is directed to conclude the trial at the earliest and examine the witnesses.

6. The Superintendent of Police, Begusarai is directed to produce the witnesses on the date fixed . Let a copy of this order be communicated to the Superintendent of Police, Begusarai forthwith, through FAX for its compliance.

7. If the trial is still delayed, the petitioner shall be liberty to approach this Court for bail.
