The petitioner seeks bail in connection with Mufassil P.S. Case No. 432 of 2015 for the offence punishable under sections 326 and 307/34 of the Indian Penal Code pending in the court of the learned Chief Judicial Magistrate, Begusarai. It has been submitted on behalf of the petitioner that no specific allegation has been attributed against the petitioner rather the petitioner and other two accused persons have been alleged to have fired on the informant. Further it has been submitted that admittedly from the first information report itself it appears that there is enmity between the parties and the petitioner is in custody for about 11 months.

Patna High Court Cr.Misc. No.48637 of 2016 (3) dt.18-01-2017 2/2 Heard learned A.P.P. also who has opposed the prayer for bail.

Having heard both sides and in view of the direct allegation against the petitioner and also considering the fact that the petitioner is accused in four other cases as would appear from paragraph 3 of the bail application, I am not inclined to grant bail to the petitioner at this stage. However, the petitioner will be at liberty to renew his prayer for bail after examination of the informant of this case.
