JUSTICE RAMESH KUMAR DATTA ORAL ORDER 17-12-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner prays for anticipatory bail in a case under Sections 420, 120B, 406 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is only an employee of the company and thus no amount has been received by him personally rather whatever amount have been deposited, were with the company. It is also submitted that the informant is also an employee of the company and his wife was an agent of the company and only to save her the petitioner has been falsely implicated.
Learned Additional Public Prosecutor, on the
Patna High Court Cr.Misc. No.42062 of 2015 (3) dt.17-12-2015 2/2 other hand, submits that it has clearly come out in the course of investigation that the petitioner is one of the main persons involved in collecting the funds from the local people by convincing them to deposit their money and it is further submitted that the informant is also the person who has deposited various receipts showing that the company received huge amount which has not been repaid.
On a consideration of the facts and circumstances of the case, this Court does not consider it a fit case for grant of anticipatory bail to the petitioner. The prayer for anticipatory bail is, accordingly, rejected. (Ramesh Kumar Datta, J) S.Pandey/- U T
