JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-12-2018 Petitioners pray for bail in connection with Excise Case No. 343 of 2018 registered for the offences punishable under Sections 30(a) and 56(b) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 2000 and odd litres of liquor from the vehicle of the petitioner and he was arrested there.

Submission of learned counsel for the petitioner is that charge sheet has already been submitted and petitioner has remained in custody for three months, having no criminal antecedent.

Heard learned APP also, who has opposed the prayer

Patna High Court Cr.Misc. No.69278 of 2018(2) dt.04-12-2018 2/2 for bail.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioners at this stage.

However, once charge has been framed or petitioners remained in custody for six months, whichever is earlier, they will be released on bail by the trial court to its own satisfaction on undertaking to be filed by the petitioners that they shall cooperate in disposal of trial. With the above observation, this application is disposed of.
